Notarizing Via Webcam... Have you heard about it?


When a webcam is used to witness a signature, the document is uploaded into a secure online system the notary provides and ensures it is in compliance with their state law. Both the signer and the notary log in and view the document simultaneously on their respective computer monitors.
The signer electronically signs the document by clicking a "Sign Here" button or similar button, and the signer verbally acknowledges his intent to sign the document to the notary.
Next, the notary countersigns the document by clicking a similar "Notarize Here" button. When the notary clicks the button, the notary's commission information, including the notary's full name, date of commission expiration and commission number, is affixed to the document along with the notary's electronic signature.
The electronic signature of the notary and the signer would appear as a "script font," much like this example:

The law requires both the signer's signature and the notary's signature and commission information be affixed to the electronic document using tamper–evident technology. Any attempt to modify the document after notarization would be detectable to anyone viewing the document. This tamper–evident technology would prevent fraudulent alteration of the document.
The notary must maintain a copy of the recording of the video and audio conference and a notation of the type of any other identification used for five years.
To ensure remote electronic signing is more reliable and resistant to fraud and manipulation than traditional notarization, the remote notary must confirm the identity of the signer by using one of three methods:
  • Personal knowledge;
  • Reliance on prior in–person identity proofing by a trusted third party which is confirmed electronically with independent database checks; or,
  • Reliance on the signer's use of a digital certificate authenticated either by a biometric or a high–security Personal Identity Verification (PIV) card (used by government employees and contractors).
In October 2015, Montana began permitting its notaries to perform webcam notarizations under specifically defined circumstances. Florida also authorized webcam notarizations, but is limiting the practice to certain law enforcement and correctional officers who are authorized to administer oaths and affirmations.
Although this process may be legal in Florida, Montana and Virginia, it does not mean the Company must insure transactions — which include documents — notarized in this manner. Transactions where the documents have been notarized in this manner or where the principals have asked if they can use a notary via webcam should be referred to Underwriting or National Escrow Administration at settlement@fnf.com for assistance.

Home prices rise at strongest pace in nearly 3 years

These are heady days for American home sellers, with a report Tuesday showing that housing prices in March recorded their largest annual increase in nearly three years.
But the gains are inflicting more financial pain on home buyers, though the price run-up has fallen well short of the annual double-digit increases during the mid-2000s housing bubble. 
Home prices across the U.S. were up 5.8% annually in March, up from 5.7% the prior month, according to the S&P CoreLogic Case-Shiller national index.Driving the increase were a longstanding shortage of both new and existing homes combined with steady job and income growth that's prompting more Americans to buy houses for the first time or trade up. 
The pace of price gains has accelerated in 2017 after year-over-year increases held fairly steady at a healthy 5% or so from 2014 to 2016.
“Home buyer demand is sky high, inventory levels are near rock-bottom and home prices keep rising,” says Svenda Gudell, chief economist of real estate research firm Zillow.

Losing Charlie was incredibly challenging and I am sure we will face struggles for months and years to come. However, through all of this, we have witnessed many amazing things as well! We witness so much LOVE, that we were overwhelmed! It truly felt like the hand of God was upon us, and this indescribable peace took over us. It was truly incredible to feel His presence with us and neither Danielle nor I could ever imagine going through this without our Faith! Every prayer was and is appreciated, and in case you wondered if it works, the answer is YES. The outcome is NOT what we desired, but there are so many stories and examples of how he was working in and around Charlie! Danielle and I are grateful for so many wishes and we THANK YOU! Know that He loves you and wants a relationship with each of us! Lean on Him in times of struggle and success! Real Estate Withholdings! Do you know. TTG

WHEN DID WITHHOLDING START FOR CALIFORNIA RESIDENTS?
The withholding law applies to dispositions of California real estate by both residents and non-residents which close on and after January 1, 2003. Previously, withholding was only required of non-resident sellers.
Why was this withholding law enacted?
As part of attempting to balance the state budget, this withholding provision was added to legislation on the last day of the legislative session in 2002. It was estimated to accelerate collection of $285 million in additional state revenue.
Who is responsible for withholding?
The law requires the buyer (called the transferee) to withhold from what would otherwise be paid to the seller.

A land contract is an installment contract in which the seller finances the purchase. The seller maintains the deed until satisfaction. It is comparable to owner financing. The buyer gives the seller a down payment and the seller acts as a bank; financing the balance of the purchase or sale price. The interest rate is negotiated by the parties.
The interest rate is negotiated and set by the parties involved. Land contracts can be created on or used on most types of property such as residential, land only, mobile home with land, commercial, mixed use.

The Role of the Title Company in Real Estate Transactions
A HOME designed to meet the individual needs of the family is a wonderful experience, but before the buyers actually get their dream home, they will run headlong into dozens of home ownership details.
The purchase of a home may prove to be the largest single nancial investment many people may make in their lifetime; therefore, the importance of fully protecting such an investment cannot be overstressed.
A basic home ownership protection essential to the security of the home is safe, sound, reliable title insurance.
But what is title insurance?
It is the application of the principles of insurance to risks which are present in all real estate transactions. These risks are divided into two main categories: Hidden hazards which cannot be detected in the examination of title and human errors which will always be with us.
Examples of hidden hazards are FORGERY, INCOMPETENCE OF GRANTOR OR MORTGATOR, UNKNOWN HEIRS, FRAUD, IMPERSONATION, etc.
Title insurance di ers from other types of insurance by protecting against future losses rising out of events that have happened in the past. There are no annual premiums. One premium, based on the amount of the sale or mortgage, is paid when the policy is issued and is good for the life of the policy.
A mortgage policy, insuring the lender, stays in e ect until the loan is paid o . An owner’s policy, insuring the buyer, is good as long as the owner or owner’s heirs own the property.
Initially, the title company will search and examine the public land records to investigate information surrounding title to the property.
The facts revealed by the search will determine:
  • That the seller is, in fact, the legal owner of the property.
  • That the “estate” or degree of ownership being sold is currently and accurately vested in the seller.
  • The presence of any unsatis ed mortgages; judgments or similar liens which must be satis ed before “clear title” can be conveyed.
  • Existing restrictions, easements, rights of way or other rights granted to others who are not owners which may limit the right of ownership.
  • The status of property taxes and other public or private assessments.
    These matters will be re ected in a preliminary report or “title commitment”. The preliminary report is issued to the mortgage lender or purchaser before the closing.
    As you can see, the title company is constantly involved in the sales transaction almost from the time the purchase agreement is signed, through and beyond the closing. Working mostly behind the scenes, but always in close coordination with agents, escrow, lenders, and legal counsel, Ticor Title strives to carry out this complex procedure in an e cient and friendly manner.

ANTHONY M. VIENNA practices tax and business law in Southern California.  He is a graduate of the University of Southern California School of Law where he received a Juris Doctorate Degree.
