Law Changes/ Recorders Changes in 2012 for California

Knowledge is power, and here are a few changes that will affect the Real estate industry in California.

Most Recorders offices in CA will be closed the next 2 Mondays as the observed Holidays.



San Bernardino County is closed today. (only one in SoCal)





Effective January 1, 2012, the county will accept paper documents between 7:00 and 7:30 AM Monday thru Friday. We will be notified, at 1:30 that there are rejections and they can be picked up at 2:00. The rejections can be corrected and re-submitted by 3:00 for same day recording. The county will make every effort to return confirmation by 5:30 but they have the option to call and indicate that they were unable to get the documents recorded and they will be recorded the next day.



Here is a portion of the new laws going into effect next year. There are a few more that may impact the real estate industry and I will get them reviewed and out to everyone as soon as I can.



Effective 1-1-2012



AB75- A witness acknowledgment will no longer be acceptable on a Power of Attorney.



Effective 4-1-2012



SB4- Make the following changes to the Notice of Trustee Sale.



NOTICE TO POTENTIAL BIDDERS: If you are considering bidding

on this property lien, you should understand that there are risks involved in

bidding at a trustee auction. You will be bidding on a lien, not on the property

itself. Placing the highest bid at a trustee auction does not automatically

entitle you to free and clear ownership of the property. You should also be

aware that the lien being auctioned off may be a junior lien. If you are the

highest bidder at the auction, you are or may be responsible for paying off

all liens senior to the lien being auctioned off, before you can receive clear

title to the property. You are encouraged to investigate the existence, priority,

and size of outstanding liens that may exist on this property by contacting

the county recorder’s office or a title insurance company, either of which

may charge you a fee for this information. If you consult either of these

resources, you should be aware that the same lender may hold more than

one mortgage or deed of trust on the property.



NOTICE TO PROPERTY OWNER: The sale date shown on this notice

trustee, or a court, pursuant to Section 2924g of the California Civil Code.

Effective 7-1-2012



SB 189- An agent will no longer be able to sign on a Notice of Completion and Notice of Cessation. These notices must be signed and verified by the owner. If the owner fails to record a Notice of Completion or the notice is invalid the time for recording a Mechanic’s lien is set out below.



8412. A direct contractor may not enforce a lien unless the contractor

records a claim of lien after the contractor completes the direct contract,

and before the earlier of the following times:

(a) Ninety days after completion of the work of improvement.

(b) Sixty days after the owner records a notice of completion or cessation.



8414. A claimant other than a direct contractor may not enforce a lien

unless the claimant records a claim of lien within the following times:

(a) After the claimant ceases to provide work.

(b) Before the earlier of the following times:

(1) Ninety days after completion of the work of improvement.

(2) Thirty days after the owner records a notice of completion or

cessation.



SB 424- If a Design Professional Lien remains unpaid it may be converted to a Mechanic’s Lien.



8319. (a) A design professional may convert a recorded design

professional lien to a mechanics lien if all of the following requirements

are met:

(1) The design professional lien expires pursuant to paragraph (1) of

subdivision (b) of Section 8306.

(2) The design professional lien remains fully or partially unpaid.

(3) Within 30 days of the expiration of the design professional lien

pursuant to paragraph (1) of subdivision (b) of Section 8306, the design

professional records a mechanics lien for the amount of the unpaid design

professional lien.

(4) The recorded mechanics lien states that it is a converted design

professional lien but shall be recorded and enforced as a mechanics lien,

except the design professional need not provide a preliminary notice to

enforce this mechanics lien. This mechanics lien shall be effective as of the

date of recordation of this mechanics lien and shall be given priority pursuant

to the provisions of Section 8450.

(b) This section shall not apply if a design professional lien expires

pursuant to paragraph (2) of subdivision (b) of Section 8306

CNBC Reports- QE3 Possible Ben Bernanke, Implications?

Federal Reserve Chairman Ben Bernanke told Congress Wednesday that a new stimulus program is in the works that will entail additional asset purchases, the clearest indication yet that the central bank is contemplating another round of monetary easing.

Bernanke said in prepared remarks that the economy is growing more slowly than expected, and should that continue the central bank stands at the ready with more accommodative measures.
"Once the temporary shocks that have been holding down economic activity pass, we expect to again see the effects of policy accommodation reflected in stronger economic activity and job creation," he said
"However, given the range of uncertainties about the strength of the recovery and prospects for inflation over the medium term, the Federal Reserve remains prepared to respond should economic developments indicate that an adjustment in the stance of monetary policy would be appropriate."
Markets reacted immediately to the remarks, sending stocks up sharply in a matter of minutes. Gold prices continued to surge past record levels, whileTreasury yields [cnbc explains] moved higher as well.
The Fed recently completed the second leg of its quantitative easing program, buying $600 billion worth of Treasurys in an effort to boost liquidity and get investors to purchase riskier assets.
While stocks rose about 6 percent through the course of the program, nicknamed QE2 [cnbc explains] , economic progress has remained elusive.
U.S. gross domestic product grew just 1.9 percent in the first three months of the year, and the second quarter does not appear to have been much better. For 2011 as a whole, the Fed sees U.S. GDP expanding 2.7 percent to 2.9 percent, down from forecasts in a range of 3.1 percent to 3.3 percent back in April.
Unemployment has taken a turn higher as well, with the economy creating just 18,000 jobs in June and the jobless rate edging higher to 9.2 percent.
Minutes to the central bank's June meeting on Tuesday suggested that, while some members were pondering the possible need for additional easing amid a weak economy, the Fed is not yet ready to take any further action.
But the minutes also reflected divisions within the central bank over further easing, and Bernanke's speech provided a further indicator that a QE3 move is far from off the table.
"Even with the federal funds rate close to zero, we have a number of ways in which we could act to ease financial conditions further," Bernanke said.
Among the options he outlined: "More explicit guidance" regarding how long rates and the size of the Fed's $2.6 trillion balance sheet will remain at current levels; more securities purchases to increase the average maturity; and cutting the interest paid to banks on reserves at the Fed, a move that would encourage the institutions to put more money to work.
"Of course, our experience with these policies remains relatively limited, and employing them would entail potential risks and costs," he said. "However, prudent planning requires that we evaluate the efficacy of these and other potential alternatives for deploying additional stimulus if conditions warrant."

QR Codes... Anyone else confused how to use?

So I have heard about the mysterious QR Codes.. I had wondered how to best use them, and how could I use them to make business easier, or make it easier to do business with me.

I was recently turned on to a free site called kimtag.com. It is site that allows you to set-up a virtual e-card that a client can scan and it pulls all of your info into the mobile device and allows the client to save your info without typing a thing.

This may make things a little bit easier.

Not So Short!

The Average length of a short sales these days is 90 days. Keeping that in mind it is wise to update your preliminary title report every 3-4 weeks! This will help in limiting the chance of any last minute surprises!

Most common lien attached during an REO transaction is a weed abatement lien by the local city!

Updating your prelim will keep you abreast of what is happening on the property and giving you ample to time address any issues as they arise!

GSEs to Begin Accepting HAFA Short Sales

annie Mae and Freddie Mac both issued new guidelines to servicers Tuesday, which allow homeowners with GSE loans to pursue a short sale or deed-in-lieu of foreclosure if they are unable to secure a modification under the government’s foreclosure prevention program.

When the Treasury’s Home Affordable Foreclosure Alternatives (HAFA) program rolled out in early April, officials explained that the GSEs’ loans were not eligible – an interesting omission considering Fannie and Freddie are operating under full government control and have been positioned as the support columns of the administration’s response to the housing crisis.
The GSEs’ exclusion from HAFA was puzzling to a number of industry experts and a common query posed by our DSNews.com readers. In response, Treasury officials said then that they were anticipating Fannie and Freddie to launch their own short sale-friendly programs – and those announcements came Tuesday.
Both Fannie Mae and Freddie Mac encouraged servicers to begin implementing their HAFA procedures “immediately.” By August 1, 2010, all Fannie Mae and
Freddie Mac servicers must have incorporated HAFA into their operations and begin offering HAFA solutions to eligible borrowers. The program is effective through December 31, 2012.
Like the original HAFA guidelines issued from Treasury, Fannie and Freddie loans must first be found eligible for the Home Affordable Modification Program (HAMP). If the borrower then fails to fulfill their HAMP obligations, a HAFA short sale or deed-in-lieu will be offered, but unlike the non-GSE HAFA program, Fannie and Freddie stipulate that HAFA can be applied only after “all other home retention workout options have been exhausted.”
According to the HAFA servicing guide issued by Fannie Mae, “All servicers must implement Fannie Mae’s HAFA for all conventional mortgage loans that are held in Fannie Mae’s portfolio, that are part of an MBS [mortgage-backed securities] pool that has the special servicing option, or that are part of a shared-risk MBS pool for which Fannie Mae markets the acquired property.
Freddie Mac’s HAFA servicing bulletin specifies “first-lien mortgages owned, guaranteed, or securitized by Freddie Mac that were originated on or before January 1, 2009.”
The GSEs will pay financial incentives to both servicers and borrowers who make use of a short sale or a deed-in-lieu to avoid a foreclosure on a HAMP-eligible loan. Servicers will receive $2,200 for every HAFA short sale and $1,500 for every HAFA deed-in-lieu completed. Borrowers are entitled to an incentive payment of $3,000 to assist with relocation expenses.
The Treasury recently raised its HAFA payouts. For both short sales and deeds-in-lieu completed on non-GSE loans, servicers get $1,500, and $3,000 goes to the borrower.
